
What is Adjustment of Status?
Adjustment of Status (AOS) is the process of applying for a green card without leaving the United States. Think of it like the background check in the immigration process.
If you entered the country legally and are the spouse, parent, or child of a U.S. citizen—or you’re otherwise eligible under an approved petition—you may be able to finish your immigration journey here at home.
Who Can Apply for Adjustment of Status
You may qualify if:
- You have an approved or concurrently filed Form I-130 (family) or Form I-140 (employment).
- You were inspected and admitted or paroled into the U.S.
- A visa is immediately available for your category.
- You are not barred or inadmissible (certain waivers may fix this).
Common qualifying situations:
- Spouses of U.S. citizens currently living together in the U.S.
- Parents of adult U.S. citizens (21+)
- Certain employment-based applicants already in valid status
- Humanitarian paths (VAWA, U Visa, Asylum) when eligible

- Average I-485 processing times range from 10 to 18 months but may take longer, depending on the USCIS office and category.
- Adding EAD/AP applications does not slow down the main case. We typically include this in a “one step” filing with the Form I-130.
- Marriage-based green cards typically include an interview under the Trump Administration; employment cases may not.i
